make an adjutment layer with curves
use it to make the top part of the photo as the bottom, try to match
contrast
for a minute just ignore the bottom looks too dark
then click mask on the adjustment layer
it should be all white
make a selection of the bottom part up to the area of difference
then feather the selection to soften it
use edit fill >choose black
you may have to adjust the mask position and./or the opacity of the curves
layer
you can use a paintbrush on the mask also if you find it easier
